S.4434 My Body, My Data Act of 2022

This bill would have increased legal protections of reproductive health information for those entities regulated by the FTC Act. Significant provisions include the following:

  • Businesses would be required to maintain a privacy policy. If the business has a website, they would also be required to publish this policy on the website.
  • Business would only be allowed to "collect, retain, use, or disclose" reproductive health information 1) with the explicit consent of the affected individual or 2) if the business would otherwise not be able to provide the service the individual has requested.
  • Individuals would, upon request, be allowed to see what reproductive health information a business has collected about them. They would also be allowed to 1) see any third parties that may have received the information and 2) request that the information be deleted.

Note: This bill was referred to the Senate committee on Commerce, Science and Transportation in 2022, but no other action was taken before the end of the 117th Congress.

 

H.R. 1224 INFO for Reproductive Care Act of 2023

This bill would require the department of Health and Human Services to develop an information campaign to achieve the following:

  • Promote legal resources to help workers in the health care field make sense of the Dobbs decision in the context of their work
  • Raise awareness about how limiting access to abortion can have negative consequences for communities

Note: This bill was referred to the House Subcommittee on Health in March of 2023, but no other action has been taken as of 4/29/24.
